Due to a change in the Utah Rules of Civil Procedure (URCP) Rule 26, you must now indicate the “Discovery Tier” when submitting a new complaint to the Utah State Courts. For complete details, click here.
When filing a new case such as a Complaint on Green Filing, the Discovery Tier will default to the appropriate tier based on your Complaint Amount. As a result, the field will display as Default Tier. If you would like to file the complaint and indicate a different tier, simply utilize the drop down box to select Tier 1, Tier 2, or Tier 3.
If the Default Tier option is selected, your filing will be submitted with the tier selected by default as follows:
- Tier 1 – Actions claiming $50,000 or less in damages.
- Tier 2 – Actions claiming more than $50,000 and less than $300,000 in damages, or actions claiming non-monetary relief.
- Tier 3 – Actions claiming $300,000 or more in damages, or actions absent a damage claim.
