For some types of pleadings, as the Court always has there may be some requirements to include sensitive or private data in your pleadings. This is particularly true in the Domestic and Probate case types. As a result, we commonly are asked the question, “How should sensitive or private data be handled within my documents when I e-file?”.

The answer, quite simply, is that it should be handled exactly the same way it was handled when you were submitting your pleadings by paper. If the data contained in your document is a required piece of data that the Court needs in order to process your filing or make a ruling, then it should be included in your document. If the data is something that your would normally redact from your document before filing, then you should continue to redact that data.

Domestic cases are classified as “Private” by the Court. This means that documents are not available electronically on these cases through xChange at all, and they are only available electronically via Green Filing if the attorney is an attorney of record on the case.
